General Terms and Conditions of Participation

1. Scope

These General Terms and Conditions apply to all courses offered by Midwife Antonia Nägele, including:

  • Childbirth Preparation Courses (German and English)

  • Postnatal Recovery Courses (German and English)

  • Pregnancy Yoga

By registering for a course, the participant accepts these General Terms and Conditions.

All courses are conducted exclusively as in-person classes at the locations specified by the midwife. Online participation is not available.

2. Registration and Formation of Contract

Registration is made exclusively via the online booking system.

A binding contract is concluded upon completion of the booking.

For courses requiring payment, a place is only reserved once full payment has been received.

Payment is due within seven days of registration and no later than seven days before the course begins. If registration takes place less than seven days before the course starts, payment is due immediately.

If payment is not received by the required date, the course place may be allocated to another participant.

3. Minimum Number of Participants

Group courses require a minimum of five participants.

If the minimum number of participants is not reached, the course may be cancelled up to one week before the scheduled start date.

Any fees already paid will be refunded in full.

No further claims may be made.

4. Fees and Health Insurance Coverage

4.1 Pregnancy Yoga

Pregnancy Yoga is a self-funded course.

The course does not have a prevention course certification ("Kurs-ID") and is therefore not recognised as a certified preventive healthcare course.

Participants will receive a certificate of attendance and proof of payment at the end of the course. Any reimbursement by a health insurance provider is solely at the discretion of the respective insurance company.

Missed classes cannot be made up or refunded, regardless of the reason for absence.

4.2 Childbirth Preparation and Postnatal Recovery Courses

For participants covered by German statutory health insurance, attended course sessions are billed directly to the health insurance provider via an external billing service.

Privately insured participants will receive an invoice from the billing service and are responsible for submitting it to their insurance provider.

Participants are required to sign the attendance sheet for each session attended.

Any childbirth preparation or postnatal recovery services already received from another midwife must be disclosed before the course begins.

If the health insurance provider does not cover the costs due to statutory regulations or because the participant has already used her entitlement elsewhere, the participant is responsible for paying the applicable fees according to the current German Midwives' Fee Schedule.

Please note that postnatal recovery courses are only reimbursable by statutory health insurance until the child reaches nine months of age. In addition, both childbirth preparation and postnatal recovery courses are generally covered only once per pregnancy or birth.

4.3 Partner Fee

A participation fee is charged for an accompanying partner.

By booking, a place for the accompanying person is reserved.

The partner fee is payable regardless of whether the accompanying person actually attends the course. No refund will be given in the event of illness or any other reason for non-attendance.

5. Missed Classes (Childbirth Preparation and Postnatal Recovery Courses)

Statutory and private health insurance providers only reimburse sessions that are actually attended.

Missed sessions cannot be billed to the health insurance provider. If the absence is the participant's responsibility, the missed sessions will be invoiced privately according to the current German Midwives' Fee Schedule.

There is no entitlement to make up missed sessions.

6. Cancellation by the Midwife

If a course session cannot take place due to illness, official orders or force majeure, an alternative date will be offered whenever possible.

If no replacement session can be arranged, or if the participant is unable to attend the replacement session, fees already paid for the cancelled service will be refunded on a pro rata basis. This applies, for example, to cancelled Pregnancy Yoga classes or to the partner fee if a partner session of a childbirth preparation course is cancelled.

No further claims may be made.

7. Cancellation by the Participant

Cancellations must be made exclusively via the online booking system.

Cancellation free of charge is possible up to four weeks before the course begins.

If cancellation occurs later or the participant fails to attend, the full course fee and, where applicable, the partner fee remain payable unless a suitable replacement participant can be found. There is no entitlement to a replacement participant.

Once the course has started, no refund of the course fee is possible.

8. Communication

Communication regarding the course will generally take place by email.

Participants are responsible for providing a valid email address and for informing the midwife promptly of any changes to their contact details.

9. Photography, Video and Audio Recordings

To protect the privacy of all participants, accompanying persons and the midwife, photography, video recording and audio recording during the courses are not permitted.

Exceptions require the prior express consent of the midwife and all persons concerned.

10. Liability

Participation in all courses is at the participant's own risk.

The course instructor is liable only for damages caused intentionally or through gross negligence.

Each participant is responsible for any damage she causes.

No liability is accepted for coats, personal belongings, valuables or other items brought to the course.

11. Data Protection

Personal data will be processed solely for the purpose of fulfilling the contract, organising the courses and, where necessary, billing health insurance providers.

The current version of the Privacy Policy shall apply.

12. Final Provisions

Should any provision of these General Terms and Conditions become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

Any invalid or unenforceable provision shall be replaced by the applicable statutory provision.
